Terms and Conditions​

1. Introduction

These Terms and Conditions ("T&Cs") govern the use of the services provided by The Park Street Group (referred to as "we," "us," or "our"). By accessing or using our services, you ("Client" or "you") agree to be bound by these T&Cs.

2. Definitions

  • "Services" means the luxury concierge and lifestyle management services provided by The Park Street Group, including but not limited to travel arrangements, event planning, personal shopping, property management, and other bespoke services as agreed upon with the Client.

  • "Client" means any individual or entity that engages The Park Street Group for Services.

  • "Website" means the website located at [https://www.theparkstreetgroup.com/].

3. Services

  • We provide a range of luxury concierge and lifestyle management services tailored to the individual needs of our Clients.

  • The specific services provided will be outlined in a separate agreement or proposal between The Park Street Group and the Client.

  • We reserve the right to refuse any service request at our discretion.

4. Client Responsibilities

  • The Client is responsible for providing accurate and complete information necessary for us to perform the Services.

  • The Client agrees to cooperate with us and provide timely instructions and feedback.

  • The Client shall not use our Services for any illegal or unauthorized purpose.

5. Fees and Payment

  • Fees for our Services will be communicated to the Client in a separate agreement or proposal.

  • Payment terms will be specified in the agreement or proposal and may include upfront payments, retainers, or payment upon completion of services.

  • We accept payment by bank transfer and credit card.

  • Late payments may be subject to late payment penalties.

6. Intellectual Property

  • All intellectual property rights in our website, marketing materials, and any materials created by us in connection with the Services remain our exclusive property.

  • The Client is granted a limited, non-exclusive, non-transferable license to use such materials solely for their personal or internal business purposes.

7. Confidentiality

  • Both parties agree to hold confidential any information disclosed by the other party in connection with the Services, whether marked as confidential or not.

  • Confidential information includes, but is not limited to, Client personal information, financial information, and business strategies.

8. Limitation of Liability

  • To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to the Services.

  • Our total liability to the Client for any claim arising out of or related to the Services shall be limited to the amount of fees paid by the Client for the specific service giving rise to the claim.

9. Termination

  • We may terminate agreements immediately if the Client breaches any material provision of these T&Cs.

10. Dispute Resolution

  • Any dispute arising out of or relating to these T&Cs shall be settled amicably through mutual discussion.

  • If the parties are unable to resolve the dispute amicably, it shall be submitted to the Courts of England and Wales in accordance with the rules of the English law.

11. Amendments

  • We reserve the right to amend these T&Cs at any time.

  • Any amendments will be posted on our website and will be effective immediately upon posting.

12. General Provisions

  • These T&Cs constitute the entire agreement between the parties with respect to the subject matter hereof and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.

  • If any provision of these T&Cs is held to be invalid or unenforceable, such provision shall be struck from these T&Cs and the remaining provisions shall remain in full force and effect.

  • No waiver of any provision of these T&Cs shall be effective unless in writing and signed by the waiving party.

13. Governing Law and Jurisdiction

  • These T&Cs shall be governed by and construed in accordance with the laws of England and Wales.

  • Any legal action or proceeding arising out of or relating to these T&Cs shall be brought exclusively in the courts of England and Wales.

14. Limitation Of Liability

  • Nothing in these Conditions shall limit or exclude Park Street Group's liability for:

    • Death or personal injury caused by its negligence, or the negligence of its employees, agents or subcontractors;

    • Fraud or fraudulent misrepresentation; or

    • Breach of the terms implied by section 2 of the Supply of Goods and Services Act 1982 (title and quiet possession).

  • Park Street Group shall not be liable to the Member, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for any loss of profits, loss of business, depletion of goodwill and/or similar losses, loss of anticipated savings, loss of goods; or, loss of contract, or loss of use or, loss of corruption of data or information whether direct or indirect or, any special, indirect, consequential or pure economic loss, costs, damages, charges or expenses arising under or in connection with their Membership; and

  • Park Street Group's total liability to the Member in respect of all other losses arising under or in connection with their Membership, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall be limited to the total value of the Member's annual Membership Fee.

  • You acknowledge that any contract entered into by you with any Supplier is an independent contract. Park Street Group hereby disclaims any and all liability for any act or omission of any Supplier or any loss incurred by you as a result of any act or omission of a Supplier whether or not arranged through Park Street Group.

  • Park Street Group shall have no liability to you for any loss, damage, costs, expenses or other claims for compensation arising from Requests or any instructions supplied by you which are incomplete, incorrect or inaccurate or arising from their late arrival or non-arrival, or any Member Default.

  • Park Street Group shall not be liable to you or be deemed to be in breach of these Conditions by reason of any delay in performing, or any failure to perform, any of Park Street Group's obligations in relation to the Services, if the delay or failure was due to any cause beyond Park Street Group's reasonable control.

  • Except as expressly set out in these Conditions, all warranties, conditions and other terms implied by statute or common law are, to the fullest extent permitted by law, excluded from these Conditions.

  • This clause shall survive termination of these Conditions.
